Yes.

However, the "mere act" of driving a machine which conforms with the
regulations defined by law, and emitting pollutants within the limits
defined by law, would not.

So if the government deems its not a crime, according to its arbitrary
definitions and even though it still causes harm, then that's OK? How
convenient. Reminds me of the way human torture has been treated
recently. It also reminds me why people think it necessary to get out
on the streets to protest politically and let down tyres and why so
many don't bother to vote.
