Even specialist transport solicitors get it wrong.
There was a notorious case a while back where West Midlands Police summonsed
an HGV driver for driving at 47mph on the A38 (M).
When the driver wrote to CM querying this and pointing out that the A38(M)
is a motorway subject to a signposted 50mph limit for all classes of
vehicle, CM's solicitor advised him to plead guilty since as the A38(M) had
no central reservation it was a single casrriageway and the limit for HGVs
was 40mph.
CM were inundated with letters from HGV drivers pointing out that this was
wrong, CM's solicitor originally stuck by his position and then retracted
it, accepting that all of the HGV drivers who had written in were correct
and he was wrong.
