I would further suggest that as the unqualified driver did not own the
vehicle (he/she was a named driver on the insurance policy) that if
he/she was driving without the owners permission he/she may be
reported for the offence of TWOC - taking without the owners consent.
If he/she did have the owners permission to use the vehicle then the
owner may be reported for permitting a vehicle to be used without
insurance.
Or, indeed, without a licence.
But only if the owner can be shown to have known that the learner was
indeed a learner.
I'd love to know what these "mitigating circumstances" are...
