If it was working and he updated the firmware the shop will not
except it back cause it was fit for purpose when sold. The owner has
altered the box (firmware) and made it unfit for purpose. The shop
may send it back to the manufacturer for repair or they may tell you
to do it yourself. Either may they will not take it back.

Fine as stated in my post the manufacturer will have to sort it. He
can not take it back to the store as the turkey stated.

Yes i do understand consumer law. which bit are you quoting to back up
your case ?

The goods were fit for purpose when they left the store.But the product
has been altered since purchase by the consumer & the manufacturer.
Therefore if it no longer works the shop has no legal oligation as the
product is not the same as when it was sold.

EXAMPLE . If you put petrol in a diesel car do you take it back to the
garage and demand a replacement cause it does not work. It's not the
garages fault. Firmware / petrol same thing. the purchaser has altered the
product since it was sold by changing the firmware.

He may or may not have had a choice in this (if the download was
automatic) but his complaint is with the manufacturer that supplied the
update not the store. The store has no legal obligation as it was supplied
fit for purpose

Exceptions: when the consumer cannot make a claim

A consumer has no rights in respect of defects that are brought to his/her
attention before the sale, or if the consumer examines the goods before
purchase and any defects should have been readily noticeable.

A consumer also cannot claim for damage he/she causes to himself/herself, or
if they damage the goods or if he/she simply changes his/her mind about
wanting the goods.

A consumer cannot claim if he/she chooses the product himself/herself for a
purpose which is neither obvious nor made known to the trader, and he/she
then finds that the item is simply unsuitable for that purpose.

A consumer has no rights to claim for faults that appear as a result of fair
wear and tear.


By updating the firmware the consumer has damage the goods !!!! no legal
obligation by shop take up with the manufacturer
