That might depend on whether the phisher is the person who
actually entered into that contract. If not -- if their site

That would be covered under a different clause:
We shall have the right to suspend the Services at any time and
for any reason. You will be given notification and you will be
notified of the reason prior to suspension of Services.
This is also acceptable to Ofcom. The difference between this and the
previous clause is that this allows for the suspension to be lifted
when whatever reason for imposing it has been dealt with. And this
doesn't require any specific notification period - 30 minutes, rather
than 30 days, would be adequate.
