Indeed you should. I went to a seminar at work, presented by the
ISA, over a year ago - and posted on here about it. Someone
raised the question then about their 16-year-old diving club (not
sub-aqua, more like Tom Daley) member who was a member but also
an instructor.

I can see that being so for someone who is an Instructor, but that
shouldn't mean it applies to anyone who sim[ly instructs occasionally.

The message then was, most definitely, he would
have to register. I had forgotten about this until now, but I may
have posted something about it.

In public argument/debate I have withdrawn my views regarding checking
16-18 year olds, bowing to pressure from those who see 16-18 year old
in positions such as YL as being required to undergo crb/isa checks/
reg.

which changed my opinion from "Yes, Explorer Scouts aged
16-18 will need to register" to "No, they may not have to
register",  the 'advice' received from the ISA person at that
time has caused e to re-think my opinion (again).

My opinion is personal.


However, we should all note that even the 'advice' from the ISA
is only an opinion, until it's tested in court. Let's hope we
don't ever go that far.

The legislation in many parts is interpretive and defintions and
standards can be made by government. I do not think it'll need to be
substantially tested in court. If the ISA say do this then people will
have to do it.


The views of many people on the issue of checking 16-18 year olds in
positions such as YL caused to me consider my position in scouting. I
found my views incompatible with what they were suggesting and what
they were certain was likely to happen. There is no one in scouting,
AFAIAA, who is actively fighting to stop a loose and widespread 'catch-
all' interpretation of the legislation.
