Thank you , but I knew it was correct I didn't need your validation.Tut tut!
By the way you never used the name Hamish on that MSN group and I still have a data base of all the members and a lot of the posts !!!!!
Data Protection Act 1998 (c. 29)
Schedules
SCHEDULE 1 The data protection principles
5. Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
Correct
but when this data shows a person did not give out their correctemail addressIrellevant to the DPA.
and then posted death threats on an MSN group I am quite at
liberty to keep them,Errr no you're not, you have no need for the information of all the ex members.
also under the MSN rules of conduct any ownership orrights to a post was given up when publicly posted on an MSN groupYou're now mixing up copyright with data protection and adding a dash of contract, neither of which supersedes the DPA.Hope this helps you yet again mark"I still have a data base of all the members" does not comply with "Personal data processed for any purpose or purposes shall not be kept
for longer than is necessary for that purpose or those purposes." no matter what MSN lets you think you can do. I take it your degree wasn't in IT or law ?
No it was not mark, but it is all relevant to the death threats I received,
Your degree is relevant to the death threats?
now be a good boy and trot off to see Mr. Plod and tell him you think I am wrong to keep data on death threats I received
It would be the information commissioner not the police, and the problem is not you keeping the death threat but on you holding "a data base of all the members" long after you had any need for that information.
You wouldn't have needed to register to hold the database when it was relevant as that would have been covered under the "social" exemption, but as soon as either MSN or you closed the area then you had no need to keep the information.
Of course it's your money, http://www.ico.gov.uk/what_we_cover/data_protection/your_legal_obligations.aspx
shows that you are in breach of at least 6 of those obligations and the IC has some sweeping powers.
