If there isn't a seatbelt, then yes. That includes cases where there
simply aren't seatbelts - my DS has none in the back, but tit's still
legal to carry back seat passengers - and cases where there are not
enough. So, for example, you ca ntake three passengers on a back seat
with only two seat belts, as long as those to whom seatbelts are
available use them.
There may be insurance issues as well, of course.
