Oh dear. Maybe they knew they were going to lose so sent the tea boy
or the cleaner ...
They try whatever they can. It's sobering to reflect that Tom's result
may have depended to some extent on the fact that he is articulate and
clear thinking. Someone who could get flustered in this situation might
not have come out so well. That's not the way things should be.
I am not convinced of that. Nearly everyone should be able to recount
the truth as they perceive it, and separate fact from conjecture.
My witness was a Turkish lady. While she was unable to express
herself verbally very well, she was very convincing when placing a
stapler to represent the van's position and a pencil to represent my
position.
She was less than convincing when she described my speed as being
about 16mph. She had previously heard me say that I was cycling at
about 15mph, and being a non-driver clearly had no idea at what speed
I was moving. She would have done better to say that she had
absolutely no idea how fast I was travelling.
