assaulted ?

That's entirely irrelevant.

The motorist does not hit/pull out in front of the cyclist because he
sees him/her and makes a decision about the suitability their clothing.

Oh yes they do. They don't make a /conscious/ decision, perhaps, just a
sub-conscious 'no threat there' decision. But people who aren't
consciously controlling their motor vehicles have no place on the public
road.

It most certainly is not irrelevant to any decision on prosecution.

Then the prosecuting authorities should be sacked. A driver who
hits /anything/ on the road is by definition not driving with due care
and attention.
