I submit that on or about Sat, 30 Jul 2005 12:59:31 +0100, the person
known to the court as "Robert" <robert@xxxxxxxx> made a statement
(<eMadnSb7INq193bfRVnyjg@xxxxxxxxx> in Your Honour's bundle) to the
following effect:

Thank you. I do wish people would stop trying to change the language.

Nobody is trying to change the language, but the word "accident" is emotive, implying that an event could not be foreseen or prevented (and yes, the formal definition does allow for a foreseeable but undesired event, but we're talking here about what is understood by the man on the Clapham omnibus, as it were).

Yes she was, she was saying it wasn't an accident when clearly it was.

No, IMO it wasn't an accident. Driving at speeds of 80mph on a road with a much lower speed limit and using it as a race track means it is clearly negligence at the very least. The word 'accident' imnplies quite clearly that there was no blame - it's just an accident after all - who could have forseen it happening. I put it to you that it very clearly foreseeable that when twunts use a public highway as their personal race track it is highly foreseeable that they could kill an innocent bystander - and they did.

Cheers, helen s
