So, you claim that no light was showing as you approached the
crossing, which will have signals on both sides aimed along the
road, but as you passed the signal the lights suddenly started
flashing. Presumably what you mean is that as you got near the
signal you saw it was flashing, having failed to observe this
before.

Not quite, I looked at them on approach about 3 car lengths and as I got
nearer still no flashing amber then as I'm just passing I see the flashing
reds IRC.

Three things to note:

1) the actions of the level crossing system will be recorded on the
data recorder. This will demonstrate, amongst other things, when the
lights were flashing and when the yellow lights were shown before
the red lights started flashing. It may record when the red light
camera operated, I have no idea one way or the other.

2) motorists often claim the sun was shining into/behind the
signals. However it is relatively easy to calculate where the sun
was and whether such assertions are true or not.

I'm telling the truth, if I was guilty of such a stupid thing I would not be
trying to find out what happened. Its easy enough to check and as the date
and time of the red light camera going off should be a doodle finding out
that the sun was extremely bright.

3) your actions could have resulted in the death of other people.

Fully understood, and thankful it did not. I'm not oneo f these idiots who
would race across a level crossing on red, I obey signals and a good safe
driver.
