Re: Britain's shame

It says a lot for McKinnon in that by his own words he believes that
he has a God given right to hack into computer system in prsuance of
any whim that comes to mind. The next time it could be your computer
or mine or my/your bank's or whoever's.

It won't be mine. I protect my computer. Seemingly the affected US
computers aren't so well protected. A startling revelation considering
their contents. Perhaps it's lack of investment that caused it? What
would the Police say if you left your front door wide open and had
half your property stolen?

Probably lecture you nicely about how stupid you had been but that
would not mitigate the offence committed which would be "entering as a
trespasser (without permission) and stealing ... or with intent to
steal. The former offences of burglary and breaking and entering were
abolished under the Theft Act. There is no longer need to show that
the defendant effected entry. A door doesn't have to be closed or
even exist.

It tests the credance of his story to find that in pursuance of
seemingly "innocent" quest he found it necessary to close over 1000
accounts on the system and to change passwords.

Apparently the security was so lax that a ten year old could have
gotten access. Perhaps heads should roll at the IT department of the
affected computers.

See above + a different matter entirely and one for the US Dept. for
Defense.

He claims "prosecutors in New Jersey wanted to see him ``fry.''
His previous nonsense ws that he feared that upon landing in the US he
might be sent directly to Guantanomo Bay.

Anythings possible. Did you hear about the 15 year old Canadian kid in
Guantanamo?

He will be extradited to the USA which comes under the jurisdiction of
the US Supreme Court which would not contenenance the removal of
anyone from US territory under these circumstances. Guantanamo Bay is
under the jurisdiction of the US Army which is the very reason why it
is sited where it is. It was specifically specifically for the
detention and interrogation of unlawful combatants who fail to be
catagorised as POWs.

McKinnon is clearly bright enough to know this. It's just a red
herring thrown in to play on the anti-american attitudes of those like
yourself. He's being deceptive. Thus far unsuccessfully.

It would be a properly constituted court that would sentence him not
the prosecutors. Whether or not he entered into a plea bargain would
depend upon the strength of the case against him. Only he would know
that.

A properly constituted court ......... Interesting. Is this the same
justice system that executes mentally retarded convicts?

There are many mentally retarded individuals languishing in prisons
here. The difference is that here we don't have any death penalty. If
we did then doubtless many would hang too.

The death penalty is prescribed by the laws of most of the US states
and those of the Federal Government.

These governments are all democratically elected and so are perfectly
entitled to set what laws they think appropriate. These laws do not
reflect in any way upon the standard and fairness of the US Justice
systems which are as good as any in the world and better than most.

It would seem that he is little more than an untruthful mischievous
fantasist. A clever one perhaps but untruthful and mischievous just
the same. He probably did what he did because he could. A few years
incaceration might convince him that even if he can he shouldn't.

Lets hope the European Courts overturn this ridiculous decision to
allow the Americans to 'fry' him.

They are not going to "fry" him under any circumstances as well you
know. Now who's being deceptive?

It is a sad day that British people cannot have sufficient faith in
British courts again part of an exemplary system by world standards to
decide such issues. Again the Europeans well known over the last
century for their standards of justice know best. It was after all the
extravagances in Europe that brought about the birth of the ECHR
wasn't it?

We were told that the enactment of the Human Rights Act would make
such referrals unneccesary.

Obviously more deception!
