I take your point. So if I simply offered, say, SD or 1st class and he picks the cheaper, it's my problem. If I offer only SD and he asks for 1st class for cheapness, it's his problem.

But presumably if I, a private seller, offer an explicit choice of SD (insured) or 1st class (uninsured and at buyer's risk), then again if he picks the cheaper it would be the buyer's loss in the event of problems, because the risk has been brought to his attention???

Who is sending the item is responsible (WHATEVER POSTAGE METHOD)

Putting disclaimers saying "I promise I'll post it but if you don't get it, its your fault not mine!" is against the law and in any court case, the seller would lose. You don't make the law nor can you change it. The law is there to protect buyers from this exact thing.

Private and Business sellers still abide by the same rules.

Just because you don't tell the inland revenue about what you are selling doesn't get you out of your responsibilities.
