Thats my gripe. She was offered the two and insisted on the cheaper
option. I didnt want her pulling out of the auction and rating me bad
if
I refused to sent the item. On my ebay auction I specified two seperate
postages. SD and SP.
Which is fair enough; she had the choice of SD which is next-day, or SP
which is 3-5 days. She was happy to save some money and not get the
goods
quite so quickly. And you still took profit on the postage!
I also have it in my buying terms and conditions that ater its left me
its not my problem and down to the buyer and RM. But having read these
messages I dont think this counts.
So I have a disclaimer saying just that, buyer, buys but my discclimer
is
againgst the law?
Almost certainly against the law if you are a trader, and unenforceable
in
any case.
All you can do is ask her to complete a written declaration that she has
not received the parcel, refund her money (and if it's Paypal you have
*no* choice as Paypal will chargeback against you) and pursue the matter
with the RM.
Owain
I told her if the postage came in any cheaper she would be reimbursed the
difference. That too is in my T&C. In 80 transactions I have yet to make a
single penny on postage. By the way she sent me £12, it was £11.20 so its
80p we are on about, which has been paid back.
Can paypal legally take the money from my account. I dont have it in the
paypal account they would need to take it directly from the bank. Can they
do this?
I think the lesson to be learned from this is to offer all options
for shipping as being "signed for" and in the case of items where
compensation of ( at present) £32 is not enough then send them SD
with no choice given .
Dunno what you'd do with items over 2KG tho' as SD would be quite
expensive ..£18 at present .
"Once bitten ( well maybe /maybe not ) twice shy"
How true. It just anoys me that she chose the postage against my express
wished. She refused to pay for Special Delivery. Now because it has gone
wrong I am the one losing out. I wanted to send it SD she refused to pay it.
Perhaps its my Autism but I fail to see how I am responsable. We have agreed
to meet hald way on this so I am not loosing out much but had she have
chosen SD i wouldnt be loosing out at all. What i did wrong was giver the
buyer the option. I should have insisted but I didnt want her pushing into
something she didnt want. She even said she was silly not to go for SD and
that she shold have taken this option.
I wont be bitten again Lesson learnt.
