Should I neg them?

In early June I won a bid for ten prints from a gallary in Paris. They got
payment mid June and the prints arrived in a damaged state early July. The
courier took back the prints and the gallary got them back mid July. The
gallary said they were going to make an insurance claim against the courier.
Then they went silent. I asked for a refund (we are taking £900 here). They
stayed silent. Threatend to report them to ebay and paypal (but it was now
beyong the 60 and 45 day limit these organisations apply to disputes!) which
prompted the gallary to say the courier is not paying insurance and I will
only get a refund, IF and when, the insurance is paid. I have emailed them
to say the dispute is between them and the courier - I want my original £900
back within 2 weeks! Maybe then I'll then try a small claim in the courts
(European Small Claims Procedure).
I've still not left negatibve feedback, should I do it now? I'm newish to
ebay so guidance appreciated!
