on Ebay in the way of business. If the seller was selling an item
privately they need to make that clear in the listing.

Her payment address is a second-hand / video shop in Chatham.
She can claim "private" sale all she likes - it's a business and that's
exactly how the law would view it.

I just wished she'd see sense and refund all of the original figure. I
cannot see why I should accept to be around £40 out of pocket with no
laptop because (a) she can't describe an item correctly and (b) the item
has a faulty screen - which she denies.

Thanks for the input huys - it's helping me put together a stern letter to
her. Not that I'm hopeful...

It's your own fault for buying something you have never seen and can't check
first. You could have got a new laptop for not much more with the same
basic spec. ebay seems to have a lot of victims of greed. Usually the same
"type" that fall for scams of various kinds. Buyer beware, not everyone
selling is honest, if it looks too good to be true then it probably is.
