No not in an auction and between 2 private sellers,


The difficulty there is that Contracts entered into via eBay may not (in the
UK at least) be considered as auctions in the conventional sense,
specifically in that the buyer has not had the opportunity to physically
inspect the goods. German Case Law (involving a trader & a consumer) &
harmonisation of EU Consumer protection laws tends towards this.


Caveat emptor still
largely applies.


Caveat emptor always applies, particularly if buying without being able to
inspect the goods. But caveat emptor is not a 'catch all' get-out clause for
the seller. As previously stated "damaged in transit, misrepresentation &
deception." are all examples of how a private seller can be held liable for
their actions.


The description must be honest but not fully inclusive of
all details.


The description should include all details which could reasonably be
considered as relevant in enabling a potential buyer to reach an informed
decision.
