You cannot get your fees refunded if you haven't paid them. As far as eBay
is concerned you owe them for the listing until the dispute is resolved. If
they are pressing you for actual payment I, in your place, would pay them
and keep eBay happy. Then continue with your claim to get the fees refunded
as 'I no longer wish to communicate with or wait for the buyer.' as you say
seven days have elapsed since you started the dispute.
It may seem a pain to pay just to claim it back, but it is eBay's ball you
are playing with so they make the rules to suit themselves.
