It's nonsense though. I've done many sessions where my remit has been "copy this sound as closely as you can". For remixes, for example, where either the masters are not available or are unaffordable.
It is not "copyright infringement" as the song is still being paid for, but performance royalties are now due to me, not the original guitarist, because I'm playing it! I always take a flat fee though.
The band in question gave permission for a cover to be recorded. What did they want - a worse, less accurate version? Why?
It's worth pointing out that the band could have made their masters available for free - they could still get royalties from sales of the game. Why should they get a flat fee as well?
