So why do you not consider a prison guard to be part of the general
public?

You have just got married and your life is looking rosy. Then one day
you see a youth deliberately smashing the windscreen of your brand new
car that you saved years to buy. In your anger you punch him in the
face and break his nose. You are therefore prosecuted and get
sentenced to 4 months in prison.

While in prison another inmate attacks you in the shower, cuts your
bollocks off and smashes your kneecap, crippling you for life.

But you say that that's perfectly OK, because it is not a crime that
has affected the general public.
