Re: Possible loss of bargain claim?

Thank you both for the advice.

The order was placed on the 30th June 09. It is definitely not a
misprice because other members on the hotukdeals forum received them
okay.

I have read through my emails to O2 and have not said that a refund
would be adequate. What I did say was that if I did not receive a
"satisfactory outcome" to my complaint then I would pursue the matter
through court. Sorry for the misinformation. I have still not had a
refund or any communication from them since 14/07/09 when they promised
a refund within 10 working days.

The only problem that I have now is with their T&Cs. They state "your
order will be accepted by us despatching the product to you." Could
this be a get out clause for them?

Thanks again.

Ian
