What you seem to be saying here is: you sued someone for a debt, your
opponent won, and his legal costs were 32k.
You call that a crime, but you don't explain why. One possible
explanation for what happened is that you didn't have a good claim to
the debt or you prepared your case badly - in which case it isn't very
fair to blame your opponent's solicitors.
Can you give us the full story or tell us where it is explained on a

It is rather old now - nearly 25 years ago but he obviously still feels
very raw. IMHO he is to a degree the architect of his own misfortune.
The gist of it seems to be that he did some building work but didn't get
paid, then sued and lost. Colin was dissatisfied with his own expert
witness (who deferred to the defendant's expert) and his own lawyers,
and disagrees with the eventual judgment of the court, but I can't see a
link to the full judgment. It may be that the judgment was unjust and it
may be that his own lawyers let him down but I don't think I could reach
any conclusions based only on what I can see on that website.
Deary me! Thank you for taking an interest and viewing my website Todal,
but I'm afraid to say that you've got it all wrong with regard to your
references to expert witnesses and lawyers. It's all there on my website,
together with the documents in proof of my claims. Thousands of people,
including a great many lawyers, have viewed my website and have had no
problem in understanding what I have to say there. I made it simple and
straightforward deliberately.
Let's see if I can condense it for you.
Bottomley got the benefit of legal aid certificates on claims that formed
his pleaded case. some of these claims were rejected by the court and the
ones that were'nt rejected by the court, were conceded to the court.
What clearer evidence could there be that the legal aid certificates were
gained by fraud and deception?
In law, he should not have been not entitled to legal aid.because, very
early in the day, his solicitors were supplied with the proof of some of
his lies, but refused to divulge this information to the legal aid board
and act in a way befitting Officers of the Court.
Had the claims stayed the same, I would have won the case.
Instead, Bottomley was allowed to put a conflicting pack of lies to the
court as to what the contract was and the judge ruled upon this new
version of contract.
The judgement was against the weight of evidence available to the court,
this evidence being that the prime witness had told two different stories
of contract and inducements to contract.
It does not take the wisdom of Solomon to know that two different stories
from one and the same person do not make for one honest account.

Yes, I still do feel very raw as do a great many other people I know who
have had similar experiences. The anger, resentment and frustration never
go away.
As I told Judge John Bullimore in a church several years ago, it truly is
the Devils own system.
You say that I am the architect of my own misfortune.
I was just an ordinary chap trying to make an honest living by working
hard.
I did'nt set out to attract a conman like Bottomley into my life, nor
once it became evident what a fraudster he was, was I prepared for all
the so called professional people and lawyers ready to aid and abet him.
It's true that the love of money is the root of all evil.
If there is any way that you think I could have avoided all this or
disuaded any of my adversaries from acting the way they did, then please
enlighten me.
But you haven't put the full transcript of judgment on your site, have
you? The one that was against the weight of the evidence etc. Or is there
a link that I missed? Maybe you don't have the transcript or would prefer
that people don't read it
My website includes all the parts of the relevant documents, including
Judges Notes of Evidence, Transcript of Judgement etcetera, which supported
the truth of my claims.
I had nothing to gain by losing my prospective readers attentions in a sea
of superfluous documentation.
The core of the judgement is on my website at document no.2 which is page 3
of the judgement.
This reads, "I am satisfied that Mr Peters agreed to do the work for the
grant money plus the slates from the roof."
The relevant documentation on my website prove this judgement to be wrong
and in conflict with Bottomleys first story of contract as outlined in his
pleaded case.
Couldn't you have stipulated that there be staged payments to you for thework you did, and then stopped work until the client paid you? If the
arrangement was that "the council" would pay your bills, that isn't an
arrangement that most builders would find acceptable unless there was a
legally binding agreement between the builder and the council.
And although you firmly believe that your client was a con-man, I don't
see any evidence that the lawyers acted dishonestly or unscrupulously.
Maybe your own lawyers could have given you a better service - that's
always a possibility.
With the benefit of hindsight there were a thousand and one things that I
could have stipulated, but, did'nt, because at the relevant time I thought
that I was dealing with a friend who could be trusted.
There was no arrangement that the Council would pay my bills. Where did you
get that from because it's not on my website.
Regarding lawyers, it seems to me that you will not see what you don't want
to see.
My own lawyers could have given me better service could they? They could not
have given me worse service and that's how I came to be on my own up against
a crook, his lawyers, and a judge. How about that for equality of arms???
