Around 6 months ago I used my debit card on a friends PayPal account.
I did this in good faith in order to buy something for him from EBay
(the item was less than £5!), he did not have the money at the time
and so I used my card and he later paid me back. I thought nothing
more of it.
A few days before Christmas I discovered that a £135 had been debited
from my current account via PayPal. I had no knowledge of this
transaction and had to report it as fraud to the bank. Eventually it
transpired that my friends ex husband had logged onto the PayPal
account and "accidently" used my debit card to purchase an item from
EBay.
At the time they both insisted that this was a mistake however neither
had the money to pay me back immediately. Both insisted it was down to
the other and I got no where.
During this time I also went to the police as the bank were insistent
that they needed a crime reference number. My friend at the time was
in Spain and is definitely the ex partner that did the transaction -
however he is adamant that it was supposedly to be a present that was
due to be purchased on my friends card. However neither would pay me
back.
The police have eventually gotten back to me and advised that
realistically there is nothing they can do. They have been to see the
person that did the transaction and advised that he must pay me back.
However they have told me that if he chooses not too then there is
nothing they can do as it is a civil matter. He has since offered to
pay me back at £5 per month.
I have a number of questions
- Is this definitely not a criminal offence?
- They have accepted delivery of the item SINCE they know that it has
not been paid for from themselves, Are they allowed to do this?
- I have suggested that they sell the item and give me the cash that
is raised, can I force them to do this?
- The transaction was done through Pay Pal (however not on my PayPal
account), is there anything they can do about this?
Currently my bank have given me a temporary overdraft to cover this
amount, Realistically they wont extend this for 2 years, which is how
long it is going to take him to pay me back at £5 per month.
The police have said so far the only thing I can do is take this to a
small claims court. I understand that this can be a lengthy process
and any advise would be appreciated with regards my options and what I
can do to resolve this matter.
The easiest way to get this resolved is to contact your bank saying
you did not authorise that transaction
they should then refund you the money
They will then take it back from paypal, paypal will then tell the
seller that the transaction has been reversed and take the money from
the sellers account, the seller will then need to contact the buyer
for payment or the return of the goods
