AOL - BROADBAND TROUBLE

I had an account with AOL and tried to 'upgrade' but they have made an absolute pigs ear of it. Their salesman claimed that I would get 'at least 6 Meg' after testing the line.
My 'up to 2 Meg' account has ended up 'down to .1 Meg' and never gets above 2 Meg which is what I already had and is why I asked AOL to upgrade the line. No upgrade at all has therefore taken place.
Part of the terms of the contract stated that if AOL couldn't upgrade the line up properly that they would restore it to how it was (back to 2 meg). They have now point blank refused to do so. I also have an email in which no mention is made of 'up to' speeds claiming that my new line will give '8 Meg downloads'
I am pretty sure that they are seriously in breech of contract and they are now calling me asking me to disconnect which I have refused to do.
I am sure they are simply trying to get me to severe the line to get them out of trouble. They are now threatening me with 'debt collectors' for the unpaid bill as I am holding back monthly payment as I can't pay the bill anyway until it is set back to the correct amount.
I am quite prepared to go to court to defend any claims but if AOL do cut the line what would I counter claim for? Could I put the cost of a new ISP contract in my counter claim?
I understand that Ofcom are invoking a new code of conduct on 5 December to control the blatant abuse of broadband speed claims. Will I be able to retro invoke this?
