Negligence doesn't need to be proven to establish liability.

If a storm rips tiles off of my roof (no negligence on my part) and
they land on a neighbour's car, it's my buildings insurance against
which he'll claim because I'm liable.

Presumably you don't live in the UK or are accustomed to a legal system very
different from ours.
