Yes, they can.
In that instance, they'd be spending their day in court explaining to the
nice magistrate why. They'd have the points added to their driving record
at DVLA in case they applied for a licence in the future, just the same
as any other endorsable driving offence committed by somebody without a
licence.
If the vehicle's registered in the name of a business entity, then it's
the Company Secretary who's on the receiving end.
Correct, although a company secretary can be another company (and I have
actually done it).
The fines for not responding to NIP's are high and now 6 points, to
discourage this, so unless it's 120mph on the M1 or you have 9 already don't
waste your time.
