phorm (again) and the CMA

Is there a loophole in the CMA 1990? The act refers to "access to any program or data held in any computer" -- but does this include the same data in transit on the internet? Or, since it has to be "on a computer" (ie vm's or phorm's) to be monitored, can access still be prohibited under the Act - thus preventing vm accessing data on their own machine?
