Pub Smoking Area

Hypothetical: A pub is going to have built such a structure as below
as a smoking area in a garden.
AB and AC are brick built walls 10 ft high.CH, EF, FG and HG are all
solid brick built walls 15 ft high
There is a roof over only the area ABDC mounted on walls AB AC -
BD and CD are not walls - they may be a line of small trees in plant
pots. X is a door from the pub.
The smoking area ABDC is well lit and heated and has chairs and tables
"inside" it. Will it be legal? - if not why not?
