Common sense, and the law for that matter, says that he does not
forfeit a right to bring a claim for personal injuries just because
he doesn't have insurance. Common sense does say that it is
difficult for the person who did the rear ending to succeed in a
claim against the vehicle in front.


Doesn't common sense say that person without insurance should not have
been on the road illegally to shunt into in the first place?

Ok , you are doing 30.5 mph in a 30 zone.
You are driving illegally so you forfeit the right to compensation if
someone rams you?



Like perhaps a new (maybe old) scam, people braking hard in front of
you to make a spurious claim for injuries.

And you don't do that , attracting the attention of the police , unless your
vehicle is legal.

Its a lesson best learnt early, keep your distance, there are most
certainly some idiots on the road.
