Do what?? A court order to deduct it from his wages? I know of no
court that goes instantly to an earnings attachment, do you?

no but ultimatly if he pisses the company off its quite probable
they would go down that route , or go for a third party order , an
easy way for them to cause a ex employee hassle if they dont pay
thier debts , and an easy way of letting the new employer know
without breaking the law


Except the guy hasn't talked at all about pissing anybody off, he's
said he is happy to make arrangements to pay it back and there's
nothing remotely easy about making a successful third party debt
order. This is the sort of scare mongering that debt collectors
engage in, listing lots of potential outcomes that are never going to
happen.

I did say if he pisses them off , i think he aleady posted he intends
to pay anyway


third party debt orders are relitively easy to obtain , so are
attachment to earnings orders

Thanks guys.Reading the literature I have it appears they will deduct the
money from my final weeks wages, and I assume any holiday pay owed wont be
forthcoming? Any shortfall they would reclaim from me, and it would be a
debt recoverable by law...think thats the wording.
Now assuming there WILL be a shortfall ,as long as I make a reasonable offer
to repay I should be OK?? After all, if I havent got £XXX in the bank, they
cant have it . IF it did go to court (and TBH I am hoping it wont come to
that), the judge would look favourably on me ,as long as I am making an
effort?
