(They could certainly *not* enforce the "leased or owned by LogicaCMG
at any time" ie on premises which they once leased but don't now - I
suspect the rest of it is as ill-thought out)
He is a smoker and is going to leave the company - could he claim
constructive dismissal?
Or we could just ask if an employer should be forced to employ stupid
people.
I would never employ anyone who smoked on the very simple principle
that they are either stupid or easily coerced by others.

So if they demonstrated impressive leadership abilities and had a CV
detyailing how they totally turned around the fortunes of several
previous companies, you wouldn't considering hiring them based on a
single criterion?
Of course I would consider it, but if I had a choice between two
similar candidates, one who smoked and one who didn't, I wouldn't
hesitate in choosing the non smoker.
