I think you have to entertain the distinct possibility that many
recipients will be guilty as charged.

Why would anyone want to download this apparently useless pinball game?
There are plenty around that are GPL or just free. Unless (as I mentioned
just now) they think they're downloading BigJugs.avi which is actually
pinball.iso, in which case they're a victim of entrapment and should
report the matter to the police.
Here's how I think you could do it.
Put pinball.iso on a computer and run eMule. On another computer, run
eMule and download pinball.iso. Rename it to WorldCupGoals.mpg, or
something that will attract downloaders. Stop eMule on the first
computer. On the second computer, log the IPs of those who download it.
After a week or so, take it offline and delete WorldCupGoals.mpg. Now run
eMule again and download WorldCupGoals.mpg. All the IPs you pull it from
are sharing pinball.iso. Get yourself a brief and issue not-too-onerous
claims against those IPs, via the ISP. Sit back and wait for the money to
roll in.
Whether they can bluff their way out of it, is another matter. Like
being caught by a speed camera, it doesn't necessarily follow that
you'll end up in court.
A speed camera shows the car. I also note that DL have omitted to include
the evidence with their letters.
Those who deserve most support and sympathy are those who did not upload
or download the offending copyright material.
Which appears to be most people who've received the letter and are posting
here.
