Hello all, my first post like many here.

I've received the letter today - my version is asking for the £350
amount.

Now in one way I'm actually relieved that it didn't say £3500 and was
quite willing to pay up just to get it over with. But then I began to
wonder if it's all a scam.

After reading all of the above posts I see that it's real.

Now why am I bothering to make my comment - I have to admit I can't
remember downloading a 3d pinball game. But I can't remember not doing
either. What I certainly remember is that I've never installed the
game and there is no current evidence of it ever being on my computer.
But I honestly don't know if it was downloaded through emule - maybe I
downloaded 5% of it or something. (Just being as honest as I can about
all of this.)

Okay, I'm still blabbing. I'll get to the point.

I'm wondering, because of what has been said already and my own
suspicions, if on the date in question - I connected to a server using
emule that was used to record my ip number and this is where my
information has been taken from, i.e. nothing to do with the mentioned
game.

Does this sound reasonable? I heard from someone that there are
servers out there that aren't all they are cracked up to be. I'm
certainly no expert and really have no idea what has been going on;
I'm just trying to think of an explanation that would explain why a
few of us have been accused of downloading something that we have no
recollection of.

At the moment, I'm almost certainly going to pay up. Personal family
circumstances mean I need this to go away quickly without causing more
stress to me or anyone else. I'd love to stand up and fight but I'm a
pessimist. Sorry.

Problem is that as well as you saying paying up, which of course is what
they are after guilty or not, they also want you to sign a declaration
which
also not only says that you did it, but also that you will not download
any
software by any company, I guess the reason this has been put in
byDavenportLyons, is that if they come up with another iffy claim, they
will
have you by the short and curlies because of the signed undertaking and
ill
know doubt ask for a lot more second time around.

From what I can understand from their letter, they are asking that I

agree to do things in relation to their client only, i.e.Topware.

So, no downloading/uploading/sharing of any products related toTopware.
This sounds like a reasonable request to me. It states that
this is for 'any time in the future'. I'm sure I can fulfil this
request/demand.

I've since checked the dates that they have quoted for the sharing
violation and it matches a time that I do have to admit my guilt. It
appears that it must be something that I downloaded via a website -
it's a German website and it has the 3d pinball game stated as being
'released' one day before the time I am accused of sharing it.

I'm 100% certian I never installed or played the game. But it looks
like I must have clicked on the link to download the game. Whether I
completed the download is another question. If I did then it must be
something that I deleted almost immediately otherwise I'd be able to
remember seeing the file.

I'm willing to accept that their evidence is correct because of what
I've stated above. If, in fact, I never even clicked on the link to
download the game then there must be something dodgy going on with the
website I'm referring to. I think this is unlikely and so I accept
that I am in the wrong - they have evidence against me, after all.

I have an unsecured wifi router (even today), I know how to secure it
but I'm sure that my neighbours aren't using my connection or have
done in the past.

AssumingDavenportLyons are not going to ask for further compensation
regardingTopwareafter this £350 settlement then I think it is a fair
price to pay. Time will tell it seems whether this is the case. I
appear guilty as charged and so I can only hope that the matter will
be concluded after they receive my payment.

I will certainly keep everyone here informed if there is anything

No, if you read this correctly you will see they indicate any downloads from
any company, which in effect means they may come for a second byte of the
cherry and with bigger demands for money.
