They can recover from the sender -there is a term concerning this on
their T&Cs on the paperwork the sender signs. Unlike the recipient,
the sender has entered into a contract with Fedex

When the recipient signs they are agreeing to pay the DUTY, VAT and
Customs clearance fee to FedEx. The have the option to refuse delivery and
should of course read what they are being asked to sign


I take it that you have never seen the electronic signature pad used when
delivering items. All that appears on it is a very brief description of the
item with its tracking number (and often just the tracking number). There
are certainly no terms and conditions or anything else (the size of the
screen would preclude being able to read them anyway).
