This is an interesting point actually. Assuming that no terms and
conditions were presented at the point of delivery (as is usual on
the electronic pads), if you sent them the VAT and duty only, how
could FedEx attempt to recover their handling charges given that
they have no contract with the recipient under which to sue?
They can recover from the sender -there is a term concerning this on
their T&Cs on the paperwork the sender signs. Unlike the recipient,
the sender has entered into a contract with Fedex
When the recipient signs they are agreeing to pay the DUTY, VAT and Customs
clearance fee to FedEx. The have the option to refuse delivery and should of
course read what they are being asked to sign
