So even though the contract does not mention the days which are being worked
they cannot ask the employee to now work 5 from seven?

If someone has transfered from the public to private sector under a tupe
agreement, can the contract be amended, to be specific the contract has
the
amount of hours that the person will work but not the days eg Monday to
Friday, the company concerned now wishes the employee to work five from
seven can this be included in the contract and would this count as a
adjustment to the original contract,which as far as I am led to believe
would lose the TUPE protection?.
The contract can certainly *not* be amended in this way without the
employee's agreement. If the new employer regards the new working
practice as essential, then he is obliged to offer redundancy to the
existing employees.
