Piracy help please! Ebay/legal advice.

Hiya,
Id really like to start a topic with no flame replies please!
But basically, if i was to sell copy DVDs or games on somewhere like
Ebay, would putting the following message get past the rules and laws
somewhat?

Legal Information:

By purchasing any of my games or DVDs, you agree that:
1) You own a 100% legitimate copy of the game or DVD.
2) You are purchasing my game or DVD for the SOLE reason to backup your
existing legitimate copy, for a reason such as you are unable to make a
backup yourself.
3) That purchasing this game/DVD without having a genuine & legitimate
copy is a criminal offence as it is in breach of copyright laws, and
may lead to imprisonment.
4) I cannot be held responsible for your choosing to ignore this
message and to illegal purchase a DVD or game.

I think that most of you will say it will still be illegal.. Will i
still get banned from Ebay if i put the message? It used to be done on
ROM sites, that is why i ask.. Perhaps theres a difference between
backing up a cartridge and a CD. You see, ive had a motorbike accident
and cant work. I have looked at several options like drop shipping, but
after extensive research and putting some money into it, it looks like
its a bad idea. Ive also researched into selling ebooks with similar
bad luck. I have bills to pay, rent to pay and im going back to college
in just 2 months to do my A levels! Im quite buggered, im even applying
for benefits this moment, but 1) I dont really wanna be a "bum" who
sits around taking tax payers money, although this may seem quite
contradictory after my question about the piracy, 2) Benefits dont pay
much & are alot of work to get.
