Re: Music Industry faces opposition to disconnections

The Open Rights Group said that the BPI's request that Tiscali and

users but for ISPs too', according to executive director Suw Charman.

Charman's comments elaborated on a boingboing posting by
copyright-reform campaigner Cory Doctorow.

'The new proposal for notice-and-termination aims at creating an even
more radical version of this judge, jury and executioner privilege the
entertainment industry has secured for itself. Under
notice-and-termination, you need only claim to be an aggrieved
rightsholder to actually knock someone's DSL circuit offline,' Doctorow

ISPs say they will pull the plug on illegal filesharers : 12:7:2006

The British recorded music industry has welcomed indications from two leading internet service providers that they will suspend service to subscribers who use illegal filesharing networks.

Trade association the BPI wrote to Tiscali and Cable & Wireless on Monday (July 10) with details of copyright infringement by 59 of their subscribers.

Early responses from both companies suggest that they will suspend accounts which have clearly been used for illegal filesharing.

BPI chairman Peter Jamieson said, "This should send out a message to people who use illegal filesharing networks that their internet connection is at risk if they break the law. Just about every ISP makes it a condition in its terms of service that using an internet connection for copyright infringement is grounds for termination.

"We welcome indications that Tiscali and Cable & Wireless will enforce those terms and conditions."

Last night (July 11) Channel 4 digital channel More 4 News reported that Cable and Wireless had issued a statement saying it would "close any accounts that were used for illegal filesharing".

The BPI's letter to Tiscali included full evidence of filesharing on one sample account and outline details on another 16. The BPI has said it can provide full evidence on all 16.

Interviewed on More Four news, Tiscali spokesman Richard Ayres said of the account holder on which Tiscali already has full evidence: "We have contacted them and given them seven days to explain what they're doing, or we will absolutely following up with the suspension"

Of the remaining 16 "we'll have to get full details on them and follow up with the due process"

Ayres said Tiscali's message to the record industry is "Come to us, give us the details and we'll absolutely work with you - and we'll work through this as we do with the police and the Internet Watch Foundation (the organisation which polices child porn)."

The BPI's Peter Jamieson said, "If ISPs do face up to their responsibilities on copyright infringement that has to be good news not just for artists and record companies, but for all the law-abiding music fans who do choose to pay their way."

Someone should point out to the bpi that p2p is not in itself illegal, it is the sharing of copyrighted material. Reading the literature on their site, they make it appear that downloading a file sharing application is in itself an illegal act.
