The nature of the Defendents computer systems requires that once a
customer account is closed, back dated printouts of mortgage statements
cannot be produced?
Personally, I think this is incorrect but how can I prove it for
tomorrow.
Take such a response at face value and 'spread***' up a set of
Mortgage transactions as you see them. Table them as evidence, stating
any areas where they may not be accurate because your information
source is not complete. Also table any documents you used to build up
your spread***. The mortgage company cannot just dismiss your
evidence out of hand if it has failed to retain records for the six
year 'statute of limitations' period.
