Anyone that the credit reference agencies will listen to can register a
default. You, however, are entitled to file a notice of correction if the
default notice is incorrect. You say that "Orange and I had a difference
of ideas" - do you owe them money or not? If you do, then pay up, and I
am sure your file will be corrected. If you don't, then you're entitled
to have the information corrected.
The Default was registered on 20th May 2005 with a 'Balance' of £149. This
was registered AFTER I had made my final payment and account balance was
Zero. Its all a bit complicated, but in July and August 2004 two payments
didnt go through and were reversed, due to reasons of family breakout, and
lack of house, I had to stay with other family members. I made a part
payment in August 2004, and then totally forgot about it all from
September - January (5 payments) as I wasnt receiving any invoices or bills
where I was staying. I called Orange to update my address once I had found
where I was going to be staying - only do find that they had passed it all
onto a Debt Collectors. This isnt a problem, but they told me that I wasnt
able to make any payments with them and that it HAD to go through the debt
collectors. When I called the Debt people, I made a part payment over the
phone in February, and then 3xMonthly payments in March, April and May and
then my account was Zero, and * Orange * themselves stopped the service
previously. On the 12th June 2005 I received a 'Final Invoice' from Orange,
which invoiced me for the extra £17 or so that I had paid from monthly
instalment and claimed it was an 'admin charge' (which isnt really a
problem).
But what I dont get, is the default was registered *after* I had finished
making the Montlhy Payments to the debt collectors. When I called Orange a
few weeks back to query this information I was informed the default was from
the invoices in June/July and August 2004 - which would've been paid and
covered in the March, April and May 2005 part payments. But all I can think
of is the debt collectors delay in passing Orange the money has caused them
to default on the amount.
I dont understand how Orange can just place a default on my account
willynilly, without informing me in writing. Had I received a default letter
I would've found a way of paying them what they were asking for as family
members were helping me with stuff.
The ending paragraph of Orange's recent letter is:
"with regard to your request for a default notice I can confirm that we
are not legally obliged to provide such a document. When your account falls
into arrears you are made aware via the collections procedure that failure
to pay your bills may affect your credit rating. This is information
captured in section 19.2 of the Orange terms and conditions"
It was hardly a helpful letter, and didint explain anything at all. From
what I can gather, Orange should not have put a Default on the account, but
should have registered 5 late payments, maybe 6. But as Orange cancelled
the contract, and I was making payments through a debt collectors (at
orange's request) how can they claim that I missed 8 payments (a default) ?!
What makes it all the more worst, is that Im still using Orange's services,
and have done since I was about 12 and I very first had a mobile phone -
only now Im on P.A.Y.G again, just like I was before I went on contract. -
nice to know how Orange treat longterm loyal customers I suppose.
