My landlords agents have sent me a S21 (Notice requiring Possession) and a
covering letter asking me what new contract I want (one choice including
the same terms). I am quite happy to continue on the existing contract and
the only reason I can think the agents have done this, is so they can try
and get more money from me for the leases etc. (I had to pay £50 or so for
my lease).
I am waiting for them to call back, but just wondered is this is "standard
practice" or just a way of conning more money from me? Should I consider
speaking to the landlord direct and get this S21 rescinded?
they have made a mistake here !! As far as I am aware the S21 has to be
unconditional to be valid so by sending it with an offer to renew it become
invalid. If they tried to enforce via a court they would fail ! That said
it is standard practice for many letting agents as they appear to know very
little about the laws.
You do not have to sign a new contract or pay fee's. You can go on to a
month by month basis by not signing. i suspect your landlord know nothing
about this so contact him direct and explain to that you would like to stay
but dont want extra fee's. He might agree, if not then you have to decide
to play game or not. You woudl be within your rights to stay at the
property until they issued notice correctly and had it enforced by a court.
