Re: Further question on deduction of wages

As I understood it, they had recalled the bank payment for your wages.

But you hadn't had any new payslip showing what deductions they were
making, so you don't know how much they are taking - they may well be
intending paying most of it.

Something is not stacking up here. What seems to have happened:
1. Casual (via agent) is issued with cell phone. Whether or not owner of
phone can get 'running balance' of calls is not known. If so whether
employer noted running balance when issuing phone.

2. Casual would need to do some pretty serious phoning to chomp through
over a weeks wages on calls. There is no indication whether calls are
itemised by phone on the invoice.

3. Casual has confessed to making some private calls with the intention of
paying for them.

4. Employer has somehow got wind that probably significant private calling
has taken place. Perhaps an invoice has arrived showing some dubious calls
or showing a significant amount of calling since previous invoice.

5. Employee the paid , then withdrew wages to cover the cost of this
alleged private calling.

6. Little is known about what has been said between casual and employer.
In particular there has been no mention of the quantity of calling. One
would have thought much more would have been discussed.

7. Casual has not been advised that wages were being 'recalled', the exact
reason and any estimated amount owing.

8. Depending on provisions of employment law, holding back pays can have
serious consequences for an employer - they would not usually do it unless
there was good grounds.

As I said, it just does not stack up.
