Hi,

I issued proceedings against a letting agent who didn't give me the deposit
on a property he let for me, after the tenant left owing 3 months rent.

Today I had a letter saying "The defendant responded to the claim indicating
an intention to defend all of the claim."

The agent doesn't have a leg to stand on (?) having told us three times
(although never in writing) that he would/had sent it, and that the cheque
must have got lost in the post.

So, why on earth would he "defend all of the claim" ?

Because he doesn't want to give you the money.

Whatever he may have told you verbally is worth the cost of the paper
it was written on.

He is presumably now going to argue about the state you left the
property in, and claim that retaining the deposit was justified.
