a couple of months ago, i invested in a fairly high end, LED based compact
torch to take out with me walking.

i purchased the torch from a uk based mail order company over the internet
(i am based in the uk)

the torch has had a couple of hours use, when i was using the torch inside
my house one evening to illuminate the inside of my sons pc case (all was
turned off!)

the torch, all of a sudden, made a huge bang, emitted a puff os smoke and
a noxious smell, the force of the bang was sufficient for it to be thrown
from my hand, leave my right ear ringing for hours, and the rubber on/off
switch at the bottom, shot out!

now, i contacted the uk based reseller, and asked their advise as to how
to proceed, i was greeted with the expected line, of the torch is covered
by the manufacturer (who happen to be spanish based) contact them and go
from there.

whilst i accept this answer in terms of getting a replacement from the
manufacturer, but if i felt that the technology or this particular brand
may in the future do this again, and didnt want to be party to it,
shouldnt i be in my rights to claim a refund through the reseller, as the
manufacturer wont dish out refunds, i may even want to swap
brand/technology or choose a more expensive model and pay the difference,
surely the reseller has some culpability here.

any info from those who know more that me, regarding retail law and basic
retail rights, would be gratefully appreciated.
