My understanding is that references have to be factual- she left of
her own volition - they overpaid her after she had tendered her
resignation so them threatening to mention this in a reference is
possibly libellous?
No, because if they did over-pay yer, and if she hasn't paid the money
then she has left the company owing them money. She might also say that if she is able to get a job she would be able to pay
If the reason not to have paid the money back is due to the fact
she cannot afford as she has spent it, the best way forward is:
She should explain to the company that she is unable to pay the
money back quickly, because, she doesn't have it ie she has already
spent it. She should make an offer to pay a set amount back each week
until the debt is paid off in full.
it back faster so it would be in the original employers best interest not to
try to down grade her reference.
