Got a friend who has been asked to be a witness for a Dad who is contesting an application for permanent 'removal from jurisdiction' (his ex-wife wants to emigrate with his kids and new husband to Australia).
The other party got wind of the fact that this guy had been asked to make a statement and are threatening him with a libel/defamation etc if he writes his statement. What he wants to say in his statement is what he believes is the truth but is damaging to the character of the new husband.
All sorts of threats of libel have been made in a not very nice way - should he be worried. Can he be done for libel for making a statement to be put into family court. He doesn't want to end up on the backend of a nasty lawsuit.
So long as he does not repeat anything outside the Court, anything said as evidence in Court is privileged and cannot result in a libel action.
