Weirdly, I just received a fax today saying he "expects" to pay by 23 Jan. So he's still alive. But his statement of account is missing December's payment and, of course, January's will be due by that date.

I think I have fair reason to believe he will not meet this payment
date  based on previous facts (non-payment for four months, unfulfilled
promises to pay by 16 December, etc.etc.) and I see no reason to hold
off from terminating the contract today and initiating court
proceedings to recover payments, interest and costs.

He has also just said that he is changing the method of payment so that
we will get the gross rent directly from the tenant and then he bills
us for his "service".

This is a joke! Even if it might be preferable for you, how would he know if the tenant hasnt paid the rent.


 This is in contradiction to the agreement for
the "Superior Management Service" that we are paying for which states
he will collect rent, deduct his fee and then pay us the balance within
10 days.  I certainly haven't agreed any change in terms, nor have I
agreed for my bank details to be disclosed to the tenant, not have I
received any money from the tenant or the agent.

Also an interesting feature in  this "Superior Management Service" is a
rent guarantee that says he will guarantee to pay rent if there is a
current rent agreement in place (there is) even if the tenant fails to
pay.  Four months missing payments amounting to more than 2000 pounds
doesn't indicate a very superior service to me!

Looks like its time to call all this nonsense to a halt and go to
court.  Possibly via HMCS Money Claim Online (www.moneyclaim.gov.uk)

Good to see that you arent letting yourself be blagged by a conman.

It will be interested to see if you get paid by 23 Jan - if he can pay by then, he could pay today!
