A neighbour has rented her terraced house property from the same landlord
for the last 46 years, the property comprises house and private road in
front of the house up to the central road camber, and a garden to the rear.
Between the garden and house there is an open passage that is land that
belongs to each house but has rights of access for tradesman working on the
properties, rubbish removal and the house tennants and their invited friends
/ family members. The house next door to this lady was bought by a
developer recently and is just nearing the completion of refurbishment.
Yesterday the developer told the lady that he had bought part of her garden
from the owners (last November) and intends to fence it off. As my neighbour
is having great trouble getting in touch with the owners to verify this. I
am wondering this:
As the portion of the garden that has allegedly been to sold to this
developer has been included as part of her rental agreement for the last 46
years can the owners sell it while there is a sitting tennant?
