I am looking at buying a business and have checked with the local council that the building has the correct usage (A3 in this case). It transpires that the current owner has never changed it from A1, but has been trading for almost 3 years.
Talk to the council planners & see if they think permission might be granted retrospectively if you were to apply for it.
Also enquire about a Certificate of Lawfulness. This is the cheapest route and does not have to be publicized. It also bypasses any legislation in the Local Plan. It has a nice ring to it as well.
